HOTTUBSCYPRUS.CY  A BOODT & KONING LTD COMPANY
WARRANTY TERMS & CONDITIONS

1) The manufacturer warranty on our Hot Tub, Cold Tub and Sauna range of products is granted for a period of two (2) years as per EU consumer rights regulations. The warranty starts on the day of delivery icw the installation and commissioning at the customer. The guarantee applies to the 1st and initial buyer and not for pursuing owners.

The warranty is covered by Boodt & Koning Ltd, a Cyprus registered Limited with registration number HE442011. Hot Tubs Cyprus is a marketing name used by Boodt & Koning Ltd and is therefore used hereinafter.

2) The warranty involves the repair of the hot tub, cold tub and sauna which weren’t visible/observable at the time of purchase, as well as occuring operational issues affection the functionality of the tub or sauna. All cost for repair (parts and labour) are to be borne by Hot Tubs Cyprus.

3) Excluded from above warranty is misuse/abuse of the equipement. This includes, for example, heating up or cooling the Hot Tub / Cold Tub unit without adequate water levels to circulate correctly. Our Sauna units are fitted with a timed-heater for a maximum single duration/use period of four (4) hrs per day. Overuse of the equipment may result in premature failure.

Wood fired heaters and their chimneys emanate heat and therefore should be used responsibly and wisely. All our chimneys have heat protection but could potentially cause burns upon touch on adults, children and pets and are therefore the owner’s own responsibility.

Electrical heaters require a stable 16Amp 220V UK style 3-pole plug connection as a bare minimum for Hot Tubs, Cold Tubs and Sauna’s. The Hot Tub E-heaters are 2100W standard, the Sauna heaters are between 6KW and 9KW on either 240V single phase or 400V 3 phase. It is of utmost importance to have a grounded connection (earth-wired). The owner is responsible for using the correct Voltage to prevent damage to the electric systems. Voltage fluctuation and/or other issues causing the electric system to stop functioning are not covered by Hot Tubs Cyprus warranty.

Furthermore, entering the tub with too many people in combination with low waterlevels [which may result in a cracking tub as a result] is not covered by warranty.

4) We further exclude warranty when the technical systems fail due to the use of poor quality water: Customers may opt not to use our pump+filter+uv-light package, which in turn could over time result in scaling particles to enter critical components resulting in reduced servicelife.

5) It is of vital importance to use only Sodium dichloroisocyanurate dihydrate (after each use of the Hot / Cold Tub) in combination with our Aqua Excellent non-chloride formula (once every week) to keep the tub and its components in optimum conditions. Failing in doing so may result in premature wear and tear in form of failing systems and/or discoloring of the tub itself.

For the Sauna ventilation after use is preferred and best performed by leaving the door slightly open, allowing excess heat and optional humidity to evaporate quickly.

6) If the wrong chemicals are used, or a combination of chemicals is used in the wrong order with a breakdown as a result, any form of warranty will be excluded. All costs to have the unit repaired back to its former state will have to be borne by the owner and are therefore not covered by the manufacturer.

7) In case of failure in any form within the stipulated warranty period, the buyer should at all times shall first touch base with the seller of the equipment. Reporting warranty at all times shall be in writing or by means of telephone contact. Repair of the issue will always be undertaken by Hot Tubs Cyprus or one of its contractors.

8) If the buyer has decided to repair the tub or its components on his own account [on either a current or previous matter] and without the written approval of the seller, Hot Tubs Cyprus will and cannot not be held responsible for any consequential damages or coverage of costs incurred by these repairs.

9) The warranty does not cover damage to personal items nor personal injury in any form which may result after the unlikely event of a breakdown of the hot tub or cold tub. Any claims made in relation to this are therefore ungrounded.

10) The warranty also does not apply on the accessories, particularly if changes to the tub and its components are made by the buyer after delivery and installation.

11) Limitation of our liability: Hot Tubs Cyprus shall not be held liable for any damages (including but not limited to loss of profits, goodwill, damages to reputation etc) and/or injury/ies that you may suffer, either as a direct or indirect result of using the hot tub.

12) The warranty does not apply if the judge destroys the binding advice. The warranty decays in case of bankruptcy, surge of payment or corporate termination of seller.

13) Jurisdiction and Applicable Law: these Terms are subject to the exclusive jurisdiction of the Cyprus Law Courts and shall be interpreted in line with Cypriot Law.
